BROKER COMMISSION POLICY

Broker Commission Policy

To qualify for a commission in a specific community, a cooperating real estate brokerage (“Cooperating Broker” or “Broker”) must meet North Mark Homes’ (“North Mark”) requirements, including the availability of a commission in any North Mark community and proper documentation of the Cooperating Broker during the first interaction between the prospective Purchaser (“Purchaser”) and a North Mark Homes representative.

For a Cooperating Broker to be eligible for a commission, the Purchaser must register the Broker at one of the following points, whichever occurs first: (i) during their initial contact with a North Mark Homes employee regarding a home or community, (ii) upon first communication or introduction to a community or home via North Mark Homes’ sales representatives, (iii) at their first visit to a community, or (iv) when attending a self-guided or virtual home tour facilitated by a North Mark Homes representative through a digital platform. Failure to register the Broker at the first point of contact with North Mark will make the Broker ineligible for a commission. Simply registering a Buyer is not enough; the Broker or an affiliated sales associate must accompany the Purchaser during their first in-person visit or self-guided home tour. If the Purchaser is not local and cannot visit in person, the Broker must join them for the initial virtual tour.

If North Mark Homes’ tracking system reveals that a Purchaser previously inquired about a community without registering a Broker or initially visited a sales office or took a self-guided tour without proper registration or accompaniment, the Broker and its associates will not be eligible for commission on any future home purchase by that Purchaser in a North Mark community. Unless otherwise agreed to in writing, registrations remain valid for 60 days from the date of submission (“Registration Period”). The Broker may extend this period by an additional 60 days by personally accompanying the Purchaser to the community’s sales office before the initial Registration Period expires.

To receive a commission, the Broker must also provide North Mark with a copy of the brokerage agreement with the Purchaser (“Purchasers Brokerage Agreement”) before the Purchase and Sale Agreement is signed. Any commission or bonus paid by North Mark will not exceed the total compensation the Purchaser has agreed to pay the Cooperating Broker under the Purchasers Brokerage Agreement. If the commission offered is higher than the Purchasers Brokerage Agreement compensation, the commission will be reduced to match the agreed-upon amount.

A Cooperating Broker will not be entitled to a commission unless they enter into a written agreement with North Mark Homes (“Broker Registration Agreement”) specifying the commission amount and any additional conditions before or at the time the Purchaser signs a home purchase contract. The agreement becomes void if the Cooperating Broker or its sales associate violates the terms of this Broker Commission Policy. Furthermore, for commission eligibility, the Purchaser must finalize a home purchase contract within the Registration Period and complete the closing under the Purchase and Sale Agreement.

This registration, including any extensions, does not prevent another broker from registering the same Purchaser with North Mark. All Cooperating Brokers are solely responsible for compensating their sales associates. Additionally, registration forms, sign-up sheets, contracts, and Purchaser incentives used by North Mark Homes are considered proprietary trade secrets.
